Terms of Rendered Services

These terms apply to Lappland Media AB (hereafter referred to as Lappland Media) and products sold through the company’s e-commerce site www.lapplandmedia.se.
Lapland Media provides both physical products, images, films and guided photo tours. Depending on the order you placed, different conditions apply as follows.

Follow recommendations

Lappland Media follows the general recommendations issued by the Swedish Consumer Authority through the Swedish Consumer Agency.

1. Physical Products

1.1 Availability and response time

Questions regarding cancellation rights, complaints, guarantees and purchases and orders will be answered by our email within 48 hours of receipt of the request. If the question cannot be answered within 48 hours, we will inform you as the consumer the reason for the delay and when the question will be answered.

1.2 Return Policy

When selling to private individuals, Lappland Media complies with the 14-day right of withdrawal and refund rules in Sweden. The consumer shall pay any return costs if the consumer exercises the right of withdrawal. Lapland Media will pay any return costs for return of the advertised product.

1.3 Sales to minors

Lappland Media does not sell products to minors (under the age of 18) without the permission of the parents.

2. Terms and conditions for the purchase of images and film of Lappland Media AB (hereinafter Lappland Media).

2.1 Using images and film

The pictures may only be used in the manner and to the extent agreed upon when ordering. Lappland Media AB always have copyright of all images/film clips and have the rights to use the images/film clips in any way if not specifically stated in a written agreement with between Lappland Media and the customer. The right to use images in addition to viewing and making sketch sketches is acquired by ordering the image from Lappland Media AB. The contractual right of use for royalty-protected (RM) images includes publishing at one point, within one year from the date of confirmation, unless otherwise agreed. Royalty-free (RF) images may, after payment made, be used with few exceptions in all forms and contexts and indefinitely, regardless of use. In all publications, images may only be published in accordance with the press’s ethical rules. Images with models must not be published in sensitive contexts such as sex, politics, weapons, tobacco or medicine. Exceptions can be made if the model approves it before publication. Photographer name / Lappland Media AB shall as far as possible be stated when publishing or other use of the image. The customer or Lappland Media AB, may not discriminate against anyone in the performance of the assignment on the basis of gender, ethnicity, disability or sexual orientation or for such reasons unfairly discriminate against persons.

2.2 Ownership and copyright

Ownership and copyright for images from Lappland Media will remain Lapland Media even after the image user has accepted these terms and obtained the image.

2.3 Costs and payment

The cost of the picture is shown in the confirmation / invoice from Lapland Media. Payment terms for the invoice are 30 days net. In case of late payment, the interest rate is charged 7 % above the current discount. If the invoice is not payed after 2 reminders, Lappland Media AB has the right to cancel any agreement with the customer. Liability for Lapland Media AB is always limited to the amount Lapland Media AB invoiced.

2.4 Digital image delivery / repro delivery and right to cancel order

In digital image delivery from Lappland Media, the image client is required to make any corrections in the digital image required for best print results. Lappland Media does not replace image commissioners or customers for unsatisfactory results in digital image delivery. Compensation for any damage is limited to the cost Lapland Media charges image commissioners for repairs. Lapland Media is happy to help with image editing according to customer wishes. If the downloaded image does not meet the client’s requirements for image editing or quality, the client has the right to contact Lappland Media for a new image which is then edited from the original RAW image. Should the client still not be satisfied with the quality, 100 % of the amount will be paid back to the client, provided that the picture has not been published. The client has 7 days to make complains about the image. Between 8 – 31 days after ordering, the customer has the right to cancel the order and then get 50 % refund provided the picture has not been published. In case of later cancellation, no right to deduction on the price is given.

2.5 Limitation of Liability

Lapland Media is not responsible in any case for financial claims due to rights or restrictions attached to persons, trademarks or other motives on loaned or used images. When using images that do not agree with the model, the image user undertakes to compensate for any damage to Lapland Media. Rights to images are not exclusive and any damage to image users thereof is not compensated by Lappland Media. Liability for Lapland Media is always limited to the amount Lapland Media invoiced.

2.6 Vite

The image user undertakes to issue to Lappland Media a penalty amounting to the greater of (1) 5 times the amount of the image use would have cost or (2) SEK 25,000, if the image user uses the image / film without confirmation or payment received, or if the image / film otherwise used in an unauthorized manner.

2.7 Dispute

Disputes arising from these terms of purchase / agreement are settled in Swedish court under Swedish law.

3. Booking Terms

3.1 Online booking

If you want to make a reservation we kindly ask you to provide the following details. Fully name & address, if possible a mobile phone number, special dietary requirements (e.g. vegetarian food or no fish eater) and everything else that may be good for us to know in advance. Please advise us on the place you stay at if you need transfers as well as the drop-off place/s and times.

3.2 Order confirmation

When booking activities or accommodation you will receive an order confirmation and an invoice. Please read the order confirmation as soon as you have received it. The order confirmation is your agreement with LapplandMedia & PhotoAdventures AB and includes the price, programme and terms that you have agreed with LapplandMedia & PhotoAdventures AB. If something is incorrect please contact us immediately.

3.3 Cancellation

All cancellation must be in writing. Cancellations can be made at no cost up to 14 days from the time of booking by sending an email to info@lapplandmedia.se. Cancellation between 15 days from the booking date and 60 days before arrival will be charged at 20% of the bookings total amount. Cancellations within 60 days of arrival will be charged at 100 % of the bookings total amount.

If people are not able to come on our tours due to travel restrictions from your own country, any transit country or due to the rules in Sweden due to Covid-19 we will move your booking to a similar date or a date you choose for 2021/2022. This without any extra cost for you. Due to the agreement with the hotels/lodge and activity companies we will need to make this decision 14-7 days prior to the tour depature. We ask you to check your own travel insurance to make sure you are covered if you have medical reasons for your cancellation. One tip is to review your travel insurance. Most companies provide extended travel protection at a low extra cost that reimburses your expenses if you yourself get symptoms of Covid-19 and can not come.

Due to the Covid-19 pandemic, you must be symptom-free to participate. If you have any symptoms that may be related to the coronavirus Covid-19, you should stay at home. You must be symptom-free at least 48 hours before travel. The guide / organizer has the right to deny you participation if you show symptoms that can be related to Covid-19. It is your own responsibility to ensure that you have travel, sickness and cancellation insurance. Check with your insurance company exactly what is included and if there are any exceptions for Covid-19.

3.4 Reservation

We do have a minimum number of guests on our tours according to the product information for the tours. I you are the only guests at the tour and not fill the minimum number; we make a reservation against carrying through the tour. You will be informed if the tour is cancelled latest 45 days before the tours starting date.

3.5 Travel and accident insurance

The guests participate on our tours at their own responsibility. We advise the guest to sign their own travel- and accident insurances. In event of an accident on our cameras an excess of maximum SEK 5 000 per incident/camera will be charged to the person who was using the camera. Please make sure you are covered also if you need to cancel the tour due to eg. medical reasons as our deposits are non-refundable and cancellations within 60 days of arrival will be charged at 100 % of the bookings total amount.

3.6 Privacy policy

For credit card payments to us to be as secure as possible, information is sent encrypted. This means that the information is sent via a secure connection and that your credit card information can not be seen by third parties. We work with an authorized payment partners DIBS regarding our credit card payments. Our partner check directly with the bank that the credit card is valid for purchase. Your credit card details are processed by our partner in the manner provided for in the international security standard PCI DSS, developed by credit card companies like Visa and MasterCard. This means that your credit card information is processed according to the strictest safety standards. If you pay by credit card, we reserve the right to verify your identity.

3.7 Terms of payment

To confirm the booking 20% of the total amount has to be paid against invoice within 14 days from the date of reservation. If the booking is made less than 14 days before tour departure/customer’s arrival date, payment of the total amount has to be carried out immediately. Final payment is due 60 days prior to departure day. If LapplandMedia & PhotoAdventures AB has not received the total amount within the stated dates the booking will be cancelled automatically.

We do also accept VISA and MasterCard via DIBS 3D Secure system. All payments are made in SEK (Swedish kronor). Ensure that you state the invoice number so that we can match the right payment with the right booking.

3.9 General information about Travel Guarantees Act

The selling of package tours is regulated in the Swedish Travel Guarantees Act. The purpose of the Act is to protect travellers if a travel arrangement is cancelled or interrupted. The Act applies to anyone who sells package tours. The fact that we have arranged a travel guarantee means that you can get compensation if any part of your package trip or interconnected travel arrangement is canceled if we were to suffer insolvency. The fact that we have arranged a travel guarantee means that you are entitled to compensation for the part of the package trip or the interconnected travel arrangement for which we are responsible and which have not been completed.
